Sustagen® Sports Trainer of the Year Terms and Conditions


1.     Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.

2.     Entry is open to residents of Australia aged 18 years or over who are Sports Medicine Australia (SMA) accredited sports trainers ("Eligible Entrant"). Employees of the Promoter, the Promoter's associated companies, the Promoter's agencies associated with this competition and their immediate families are ineligible to enter.

3.     The competition commences at 7.00am Australian Eastern Standard Time ("AEST") on 21/5/09 & closes at 11.59pm Australian Eastern Daylight Saving Time ("AEDST") on 21/10/09 ("Competition Period").

4.     Monthly winners: Entries will be individually judged and monthly winners announced on the following dates 22/06/09, 22/07/09, 24/08/09, 22/9/09 & 22/10/09. The major prize will be adjudicated on the 18/11/09.

5.     To enter, go to www.sustagensport.com find the "SUSTAGEN Sports Trainer of the Year" link and follow the prompts to submit your entry, including telling us in 250 words or less "How have you used nutrition education to assist your club's participants to perform at their sporting peak?" Responses will be judged upon both their use of nutritional education to achieve better performance (ie. PB times, match results, minimise dehydration) for their members/club as well details on their creative education methods.

6.     Entry is limited to once per person.

7.     The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entrant for tampering with the entry process, including but not limited to providing incomplete or false information, making multiple entries or for submitting an entry that is not otherwise in accordance with these terms and conditions.

8.     This competition is a game of skill and chance plays no part in determining the identity of the prize winners. All valid entries received during the Competition Period will be judged on their merit. Five entries will each win a monthly prize, (one prize per month during the Competition Period). The major prize will be awarded to the entry judged to be the best overall from the monthly prize winning entries.

9.     Prizes are as follows:
a)    Monthly prize is a range of SUSTAGEN Sport products valued at $500 recommended retail price ("RRP");
b)    Major prize is valued at up to $8955 and includes the following:
i    Attendance at the Sports Medicine Australia (SMA) conference in November 2010 (venue to be confirmed) and includes: 2 return economy airfares (if required) from the winner's nearest capital city to the nearest commercial airport to the SMA conference; return transfers between the airport and the conference venue; 6 nights twin share accommodation at a 3 star hotel including daily breakfast; and conference registration for the winner (1 person). Flights and accommodation are subject to availability at time of booking. Additional spending money, meals, transport to & from departure point, additional transfers, insurance & all other ancillary costs are the responsibility of the winner. It is a condition of accepting the prize that all components of the prize be taken during the trip and all persons taking the trip depart from & return to the winner's nearest capital city at the same time unless otherwise agreed by the Promoter & that all persons taking the trip sign a waiver of liability & an indemnity in the form determined by the Promoter in its absolute discretion. Promoter accepts no responsibility for variations in trip prize value. The prize must be taken to coincide with the "SMA Conference" in November 2010.
ii    A range of SUSTAGEN Sport products valued at $2,000 RRP.
iii    Registration and admission for one person to a Sports Nutrition Education course (held in the winner's capital city) valued at $225; and
iv    A "Nutrition Night" for the winner's sporting club sponsored by the SUSTAGEN team and includes catering and education valued at up to $1,500.

10.     Judging will be conducted at Elite Sports Properties, Level 3, 649 Bridge Road, Richmond Victoria 3121. The entry judged to be the best received each month will win the Monthly prize. At the end of the Competition Period, the entry judged to be the best received overall will win the Major Prize.

11.     All prize winners will be contacted by phone and the names and postcodes of prize winners will be published at www.sustagensport.com as follows: monthly winners will be announced on 22/06/09, 22/07/09, 24/08/09, 22/9/09 & 22/10/09; and the major prize winner will be announced on 18/11/09.

12.     Total prize pool is valued at up to $11,455 RRP.

13.     Prizes are not transferable & cannot be taken as cash, unless otherwise stipulated.

14.     Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prizes.

15.     The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.

16.     Each entry becomes the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting www.nestle.com.au or calling 1800 005 510.

17.     Promoter's decision is final and no correspondence will be entered into.

18.     The winner should look to the manufacturer of products and provider or services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of these terms and conditions to be void.

19.     In the event that any prize item is unavailable despite the Promoter's reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.

20.     By entering the competition, the prize winner agrees to the use of their name, image and photograph/s for publicity and promotion purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.

21.     By entering the competition, each entrant agrees to the use of their 250 word statement for printing, broadcast, publicity and promotional purposes, including but not limited to the Promoter's websites without compensation, and agrees that the Promoter will own all intellectual property rights, including copyright, in any such material. It is a condition of accepting any prize that the winner acknowledges that the Promoter acquires the 250 word statement for use for its commercial purposes and agrees not to object to any such use on the basis of any moral right.

22.     Prizes will only be delivered in Australia and each winner should allow 28 days from judging for delivery of their prize.

23.     If for any reason this Competition is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Competition, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Competition. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.

24.     Entries are deemed to be received at the time of receipt into the Promoter's database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person's handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Competition.
